My mom has a phone subsidizing contract with Rogers that isn't up until May 2011, but she would like to get an iPhone 4 now. She went to a Rogers Store but they said her account was locked until next May. She sent an email to their support address and they replied with the same thing.

They said her only option is to cancel the contract and pay a $120 penalty.

I told her she signed the contract so she shouldn't be too upset with them for wanting it to finish, but at the same time, this is an opportunity for them to sign her to another 3 years (she has no problem folding the new contract into her current one, so actually 3.5 years) but they don't seem interested in that.

Is there any way for her to get the iPhone 4 and a new 3 year contract without having to pay the penalty on the old contract?

If her last contract was 3 years and she only has about 6 months left on the current one, she should be eligible to upgrade to the iPhone on a new 3 year contract. You should go to the store with her and find out why she is not eligible for the upgrade. Mind you, for her to get the iPhone 4 at a good price, she'll have to add a 3-year data plan.

there was a promotional window which is now expired. if you want an i phone 4 so bad then you can pay full retail for it. otherwise wait till 6 months left on your voice term.
