The injunction sought by TELUS to remove a Mobilicity television commercial from broadcast was denied by the British Columbia Supreme Court.

Mobilicity has been running a commercial with the theme 'What you see isn't always what you get' with regards to unlimited calling offers by leading wireless carriers.

“We are happy with the court’s ruling and that Canadian wireless consumers are still free to engage in a dialogue with each other about the many challenges facing Canadian wireless consumers – that’s what our TV commercial is all about,” said Mobilicity President and Chief Operating Officer Stewart Lyons.

TELUS took issue with Mobilicity's claim that carriers placed limits on unlimited calling plans by restricting them to evenings and weekends. Also objectionable to TELUS was Mobilicity's "no contracts" claim even though the company's services are governed by service terms and conditions.

Although TELUS wanted to block the commercial before the holiday season peak, it still plans to continue legal action in early 2013.
