Any legal minds here who can comment on the apparent double-standard in his neighbourhood's restrictive covenant regarding 24" satellite dishes but no TV antennas? It seems to me that in a contract or by-law this could easily be argued, but I'm not sure how well that would apply in a covenant.

Yes, exactly. There was a two-page list of Restrictive Covenants in the agreement to purchase.

Default Antenna By-laws

In Westmount (QC), there is a bylaw on antennas that states that it must not be visible from the street. Given the way homes are built around here, it is not hard to do. As well, the law applies equally to satellite dishes.

Despite all this, I don't think it is really enforced, given the amount of satellite dishes (and a couple of UHF antennas) I can see from the street.

I'm interested in knowing how these covenants in purchase agreements are enforced. Do the "subdivision police" swoop down and confiscate your antenna? I suspect that some of them wouldn't stand up in court.

It's probably a complaints-based system. There's no enforcement until someone complains.

not sure where to post this but... I was wondering if anyone knows if canadian stations are required at some point to give at least some sort of program info as the american stations do.

I know that CHWI and TVO have been sending this info intermittently, but this could just be their decision and have nothing to do with regulations from CRTC or IC

Default OTA is illegal? (Answer: No)

I just called Rogers to cancel my basic cable service. The CSR from Rogers asked me why I cancel and told him that I am planning to go OTA. He said to me that the government recentlty made OTA illegal. Is there any truth to that? or is it an attempt to discourage me from cancelling their service?

You should report that comment to someone within Rogers supervision and management. If OTA was illegal, then why does the government regulate licensing to broacasters for broadcasting OTA. The radio spectrum is a sovereign and public domain and it's useage in Canada is regulated through 'Industry Canada' and the 'CRTC'. The use of the radio&tv spectrum is not determined or regulated by broadcast re-distributors such as cable and satelite service providers.

The answer to the CSR's comment is,.. OTA is very legal!

The (first line) CSR may have been thinking about encrypted FTA, or misinformed about the recent OTA change from analogue to digital. Remember that CSRs are minimum wage people who often don't know what they are talking about outside of what they're reading on a screen. Some are better than that, but again, don't expect much.

My guess is simply another case of an ill informed customer service rep or one that simply misunderstood what you were asking.

Probably confused OTA with FTA.

FTA was mainly used by hackers a few years ago but not anymore.

I specifically told him that he might be mistaken for Satellite Free-to-air, and what i was talking about was "Antenna" and "Over the air" and "signal from the CN Tower". He was still saying that it is illegal. He even said the "government made it illegal just just few months ago".

Mind that he wasn't very nice right off the bat. He said that he will only terminate my cable TV in 30 days and not right the way as I requested. Which was fine as the terms of service stated that i needed 30 days advanced notice to cancel cable. But i said i want to return my digital cable box right now and don't want to be charge for it for another 30 days rental fee. He declined saying that the cable box was "part of the cable package" and i will be charged for it for another 30 days. I then challenged him to show me where in the terms of service agreement that I need 30 days advanced notice to cancel a digital cable box. He finally conceded and said yes the cable box won't be charged if I give it back right the way.

Man, am I glad to get away from Robbers.

PS: He wasn't first line CSR, he was the retention guy.
