Quebec couple wins right to complain about landfill

A Quebec Superior Court judge has dismissed a lawsuit filed by the owners of a toxic landfill against a couple who complained about the smell coming from the site. The lawsuit was filed against Serge Galipeau and his wife Christine Landry, of Cantley, Que., just north of Ottawa, after they complained about the smell of hydrogen sulphide gas emanating from the landfill. Justice Pierre Dallaire ruled that the $1.25-million defamation suit, if allowed, would interfere with the public's right to free speech. Dallaire said the landfill owners filed the suit to intimidate the defendants against making further complaints.
