Just curious to see how people think the Supreme Court decision on the Grey Market will come down. I'd like to see answers on what you think will happen, not what you'd LIKE to happen.

I think that it will be legal.
The court should not create legislation.
And they will have some political message to that effect.

Usually when a court case is being conducted, you always hear people say they can't comment, blah, blah, blah.

But for some reason, the opposite is happening here.

You have Copps(hard to believe she's related to her dad) blabbing away that she will ignore the results if she's not happy. The you have the CRTC chairman saying basically the same thing.

Hopefully the media will point these things out (except for the Red Star) if we lose.

So, back to the original question:

According to the law today we should win but since this thing is so political we won't.

I'm cynical, I think the supreme court will play politics and rule in favour of ExpressVu and the Government.

I know, everyone is going to say that supreme court is unbiased etc but then they said that about the US supreme court prior to the Nov 2000 presidential vote in the US.

BTW where is AL Gore these days?

I would add that I HOPE that any court can remain independant.
I see them ruling and then adding on, this is how the legislation must read in order for us to rule in favor of Bell. Therefore giving the gov what they need for the next time.

Ya I am afraid of that and tend to agree. All the Supreme Courts Judges except one come from the Liberals.


The Supreme Court said that there would not use the Charter in their Decision because the lower Court did not.


That leaves the door open to challenge if the law is consitutional or not. I do believe any ruling or legislation change of the law will clearly infringe on 2b of the Canadian Charter of Rights and Freedoms.


Tobaco companies have won on the Charter to advertize and child ponography has won the Charter. Zundel the hate literature guy also used the Charter. In relation TV signals does not kill or offer kidie Porn or hate proporganda.

I can not understand how the court can rule any way other than in favor of Can-Am. The people at Can-Am have done nothing wrong and are clearly the victims here.

If the court does some how manage to rule in favor of Bell, it will be a sad day in Canada for freedom of choice and democracy. I will be embarrased to live in a country that bans it's citizens from watching TV from another country.

That all said, my dish stays up until the RCMP come to my home and rip it down.

Bell wants to control the media industry like they did the communications industry. The Supreme Court is controlled by the government. It's sad but true.

Logic tells you that Can AM is the victim and Bell is the bully but Bell gets what it wants.

The government shot down Directv's entry into the Canadian market place back in 1994 by changing the rules.

The rules will be changed again.

I guess I have more faith in our courts than you. I don't think taquila Shiela has that much influence in the world anyway.
