When Bank of Nova Scotia became the latest major corporate sponsor of Toronto’s Caribana festival – a cultural juggernaut with an estimated $300-million annual impact – the bank believed it was entitled to a little more than its name atop the festival’s banners. (http://www.theglobeandmail.com/news/technology/scotiabank-fails-in-bid-to-snag-caribana-domain-name/article1546808/)

The domain name was registered in 1997.

I honestly can't believe that because they sponsor the festival, they can suddenly steal a domain that was registered in 1997 and has been in use since that time.

I can understand if maybe the organizers of the festival were fighting for it but Scotiabank?

I can understand if maybe the organizers of the festival were fighting for it but Scotiabank?According to the article:Scotiabank counters that it was simply acting on behalf of Caribana festival management, and had it won the case, would have handed control of caribana.com over to the organizing committee.

“We wouldn't have kept it,” said Scotiabank spokeswoman Ann DeRabbie. “As a financial institution we’re not interested in holding on to that domain name.”Still, it seems very heavy-handed to go after the organization that owns the name and which apparently has promoted the festival for years.

Maybe now they can focus on harassing the owners of the .ca domain name...

Goto the site and it All makes sense.

The site is all about the festival and I'll bet it gets millions of hits ... oh and the main advertiser on the page is TD Canada Trust!

I guess the fact that the site refers to the festival as the "SCOTIABANK CARIBANA FESTIVAL" just isn't good enough. It must be tough being a financial institution these days... :)

It's a prime advertising opportunity for Scotiabank. They have plenty of branches all throughout the Carribbean and Mexico, and a surprising number of people from these countries are aware of and travel to Canada to attend Caribana. It's not just the local community that celebrates it.

I just read the articile today that Scotiabank denied web domain.

I'm a member of the FMC SCOTIABANK CARIBANA Festival in responce to this the Caribana word is Trademarked and protected to what i believe

Scotiabank has a legal right to that domain name as they are partner of caribana for the past 3 years.

ADMINISTRATIVE PANEL DECISION
The Bank of Nova Scotia v. Working Word Co-operative Ltd. (http://www.wipo.int/amc/en/domains/decisions/html/2010/d2010-0167.html):
Respondent evidence is that it registered the disputed domain name in 1997 in good faith and with the approval of the Caribbean Cultural Committee, the CARIBANA festival organizers since the festivals inception in 1967. Caribbean Cultural Committee members and staff provided Respondent with the information to update the website and made specific requests of Respondent regarding the timeliness for the website updates. Respondent has posted Caribana festival information on the website associated with the disputed domain name continuously since at least 2001.
. . .
The Panel concludes on the basis of the evidence presented by the parties in this proceeding that on a balance of probabilities Complainant has failed to prove that Respondent registered the disputed domain name in bad faith.

Question: Were do the ad revenvues from the caribana.com currently go? Follow the money I say.

"Donna McCurvin", is only the person who registered the domain on behalf of,

Working Word Co-op Ltd.
ATTN CARIBANA.COM
care of Network Solutions
PO Box 459
Drums, PA 18222
US
570-708-8780

So why does Network Solutions end up with the domain?

I miss your point Jake. Are you saying that the domain should be given over to BNS?

(FYI: Network solutions is simply the registrar)

Scotiabank counters that it was simply acting on behalf of Caribana festival management, and had it won the case, would have handed control of caribana.com over to the organizing committee.

I think the Caribana Organizing Committee should be in control. Unless the statement by BNS is false.

The name " Caribana " is a trademark name for the Scotiabank Carbana and Scotiabank is the partner and should have controlling access. which they do have contorl with caribanafestival.com

Want a laugh, take a look at http://www.caribana.ca/ Why isn't BNS going after that when its a .ca?

Now goto Google and see what site comes up first when you search on Caribana.

This is just about BNS mad because caribana.com comes up in search ahead of caribanafestival.com
